Subpoenas

A subpoena requires the person to whom it is directed to attend and give testimony at the time and place specified in the subpoena.  Hawai’i Rules of Penal Procedure (HRPP) Rule 17(a).  A subpoena may also command a person to produce books, papers, documents or other objects. HRPP Rule 17(b)

If you receive a subpoena, please do the following:

  • Read everything on the subpoena.
  • Call the phone number in the box on the subpoena as soon as you receive it.
  • Keep our office informed of your current address and phone numbers.
  • Call the phone number again on the subpoena on the day before the scheduled court date.

If you cannot locate your subpoena, please call our main phone number at (808) 961-0466 in Hilo, (808) 322-2552 in Kona or (808) 887-2001 in Waimea. They will refer you to the correct person. If you know the case number, please have it available when you call.

Read Your Subpoena

The subpoena shows the date, time, and location where witnesses are expected to appear and testify.  Note which  specific courtroom you are subpoenaed to as there are several courtrooms throughout the county. Witnesses should call the phone number provided on their subpoena as soon as they receive it.  In addition, it is recommended that you call again the day before the reporting date to confirm the date, time, and location. Failure by any person without adequate excuse to obey a subpoena may be deemed criminal contempt of court. HRPP 17(g) and HRS 710-1077.
